Use of Nuve's Website and Platforms
These contractual terms and conditions (hereinafter the "Terms and Conditions") regulate the use and govern the legal relationship established between Valeria Rivas Moreno (hereinafter "Nuve"), the Client(s) and/or Users for the provision of services and sale of products on Nuve's platform and/or website, currently hosted at https://nuvenu.mx/ (hereinafter, the "Website"). Nuve is controlled by an individual residing at Avenida Coyoacán no. 100-D, Colonia Del Valle, Alcaldía Benito Juárez, CDMX, C.P. 03100.
Nuve sells jewelry and related products made with .925 silver and its combination with textiles (hereinafter the "Products") inspired by the traditions, shapes, and colors of Mexico through its Website.
Any person accessing the Website is obliged to use its contents and services, as well as to purchase the Products, in accordance with applicable law and these Terms and Conditions.
Nuve is a brand duly registered with the Mexican Institute of Industrial Property. Our customer service email is contacto@nuvenu.mx through which you can request clarifications or file any complaints you deem appropriate.
Nuve reserves the right, at its sole discretion, to change, modify or remove all or part of these Terms and Conditions at any time. It is the User's responsibility to constantly check and consult these Terms and Conditions to be aware of such changes or modifications. As long as the User complies with these Terms and Conditions, Nuve grants exclusive, non-transferable and limited use of the Website, reserving Nuve, at its sole discretion, the right to eliminate, remove or limit the use of the Website to any User.
All access to the Nuve Website is subject to the provisions of these Terms and Conditions, regardless of whether an account is registered or not.
Capitalized terms shall have the following meanings, unless otherwise stated in these Terms and Conditions:
User. Refers to the user (any natural or legal person who is not a Client, hereinafter the "User") who accesses and browses the Website, agrees to be subject to these Terms and Conditions as they exist at the time of their access to the Website.
Client. The User who wishes to browse the Website, as well as to purchase any of the Products, will be considered for the purposes of these Terms and Conditions as a "Client", and must at all times accept these Terms of Use, the Privacy Policy, and follow any instructions that Nuve may establish for obtaining such status.
Nuve's Client must consider that there is a full acceptance of Nuve's Terms and Conditions, Nuve's Privacy Policies, as well as the Terms and Conditions of Nuve's third-party providers such as Shopify's Terms of Service or its Privacy Policy. The processing of personal data of the Client and Users will be carried out in accordance with the provisions of Nuve's Privacy Notice available at the following link https://www.shopify.com/legal/privacy.
Nuve reserves the right to carry out campaigns or promotions at any time to promote the registration of new Clients to its service. Nuve may at any time modify the conditions of application of promotions, extend them, or exclude any Client or User if it deems it convenient.
Every Client or User who accesses and browses the Nuve Website declares to be over 18 years of age with full legal capacity to enter into contracts under the laws of the United Mexican States and undertakes to use the Website, Social Networks (as such term is defined below), the content, service and/or any Nuve platform, in accordance with applicable law and these Terms and Conditions.
It will be the Client's exclusive responsibility to carry out everything necessary to access the Website. The Client assumes the consequences of allowing third parties to access the Website through their devices, their profile and/or their Internet connection, as all actions carried out through such means will be attributed to them personally.
When Clients and/or Users browse the Website, Nuve uses cookies so that they do not have to enter their data each time they access. These cookies are restored each time the Client accesses the Website and last approximately one month.
By making any purchase, the User guarantees that: i) they are over 18 years of age; and ii) they have full legal capacity to enter into binding contracts such as these Terms and Conditions.
All information provided by Users is declared under oath, being responsible for the personal information provided and releasing Nuve, its companies, affiliates, subsidiaries, partners, shareholders from any liability related to said information.
Social Networks. These will be Nuve's official pages on the different social network platforms that exist on the web and that Nuve uses, including but not limited to Facebook, Twitter, Instagram, among others. The User or Client who wishes to use or browse Nuve's Social Networks must accept the Terms and Conditions established for such purposes by the providers of said services, so their use will be the sole and exclusive responsibility of the User and/or Client.
Intellectual and industrial property.
Nuve and its design are a registered trademark before the Mexican Institute of Industrial Property ("IMPI"), so any use of the same or any similar distinctive sign that causes confusion about its origin or ownership by Client, Users and/or any third party without prior authorization from Nuve or its rights holder is expressly prohibited.
Total or partial reproduction, in a similar degree or causing confusion, of the jewelry designs presented on the Website and/or any Nuve platform is strictly prohibited.
Total or partial reproduction of this Website, not even through the use of a link, or any of its contents, is strictly prohibited without the prior express written authorization of Nuve.
Nuve does not grant any express or implicit license or authorization over intellectual and/or industrial property rights or over any other right or property related, directly or indirectly, to the contents included in the Website.
Nuve makes its best efforts to ensure uninterrupted availability of the Website. However, access may be temporarily interrupted by maintenance tasks, by uploading updates, new Products, or for reasons beyond Nuve's control.
Nuve assumes no responsibility derived from the foregoing at any time; some of these exclusions are mentioned by way of example but not limitation below.
- a) For the use that Clients or Users may make of the materials on the Website, App or other linked internet sites, whether prohibited or permitted, in infringement of the intellectual and/or industrial property rights of the web content or of third parties.
- b) For infringements of intellectual and industrial property rights that third-party collaborators of Nuve may commit in relation to the Products or with the materials supplied for the sale of Products.
- c) For eventual damages caused to Clients or Users as a consequence of normal or abnormal operation of the search tools, of the organization or location of the contents and/or access to the Website and, in general, of the errors or problems that arise in the development or implementation of the technical elements that the Website or a program provides to the Client or User.
- d) For the contents of those pages that Clients or Users may access from links included on the Website, whether authorized or not.
- e) For the acts or omissions of third parties, regardless of whether these third parties may be linked to Nuve through a contractual relationship.
- f) For the access of minors to the contents included on the Website, being the responsibility of their parents or guardians to exercise adequate control over the activity of the minors in their care or, to install some of the tools for controlling internet use in order to prevent access to materials or content unsuitable for minors, as well as the sending of personal data without the prior authorization or consent of their parents or guardians.
- g) For errors or delays in accessing the Website by the Client when entering their data in the purchase process, the slowness or impossibility of reception by the recipients of the order confirmation or any anomaly that may arise when these incidents are due to problems on the Internet, caused by fortuitous event or force majeure and any other unforeseen contingency beyond Nuve's good faith.
- h) For failures or incidents that may occur in communications, deletion or incomplete transmissions, so that the Website is not guaranteed to be constantly operative.
- i) For errors or damages caused to the Website by inefficient and bad faith use by the Client or User.
- j) For the non-operability or problems in the email address provided by the Client for sending the order confirmation.
Nuve commits to trying to solve any problems that may arise and to offer all necessary support to the Client to reach a quick and satisfactory resolution of any incidents that may occur.
The Client or User may join Nuve's Social Networks; the User who becomes a follower of the content or profiles must accept the privacy and use policy of the corresponding Social Network.
Nuve performs the following actions: i) Access to public profile information, ii) At the user's request, publication on the User's profile of information about Nuve, iii) send individual messages through the Social Network channels, when permitted, iv) updates of the page status that will be displayed on the User's profile.
Nuve reserves the right to hold contests, promotions, and sweepstakes, in which Users who are linked to its page may participate. The rules for each of these, when conducted through the platform of the corresponding Social Network, will be published therein, in accordance with applicable and current legislation.
Nuve may use any Social Network to advertise its Products. In the event that it decides to process your contact data for direct commercial prospecting actions, it will always comply with current regulations and those of the platform itself.
Part of the Website may include advertising content or be sponsored by third parties unrelated to Nuve. Advertisers and sponsors will be solely responsible for ensuring that the material submitted for inclusion on the Website diligently complies with applicable laws.
Nuve will not be responsible for any error, inaccuracy, or irregularity that advertising content or sponsors may include.
The destinations of links that may appear on the Website, Social Networks, and other platforms are not under Nuve's control. Nuve is not responsible for the content of any linked destination site, or for any link included on a site reached from Nuve's Website, or for any changes or updates to such sites. The inclusion of a link does not imply Nuve's acceptance of the content that the link may have.
Nuve Sales Conditions
The Website will include the process, amounts, availability, and other characteristics of the products that Nuve offers to its Clients. Nuve may modify the list of products according to their availability, expand, reduce, eliminate, and/or perform any action on the list of products published on its Website.
The purchase of products is subject to all terms established herein, so Users may only acquire such products through the Website and or any other means previously established and authorized by Nuve.
Nuve does not include refunds for product acquisition within its services, so the Client hereby waives any action or right to request a refund for payment of any product.
The descriptions, photographs, graphic or iconographic representations and videos related to the Products, as well as trade names, trademarks or distinctive signs of any kind contained on the Website, are intended to guide and provide as much information as possible to the Client or User; however, Nuve assumes no responsibility whatsoever for the accuracy of such images or descriptions of the Products since they may be altered by computer programs for advertising or marketing purposes.
The Client, prior to purchasing the Product in question, must review the description and characteristics of the Product and any other condition (including, without limitation, compliance with any term and condition, rates and reservations established) and be in conformity with them before purchasing the Product or contracting the Service. In case of conflict or contradiction between the Product descriptions and the additional conditions included in its sale, the latter shall prevail over these Sales Conditions. Consequently, the Client must carefully read, in addition to these Terms and Conditions, the descriptions and conditions applicable to the sale of each Product, which shall be deemed accepted at the moment the Client proceeds to purchase the Product in question.
Payment Procedure and Authorization by Clients. Payments will only be made through Nuve's Website, through third parties subcontracted for such purposes and duly authorized by Nuve. Once the payment is processed and authorized by Nuve, a confirmation notification will be sent to the Clients.
Clients accept that Nuve manages payments through authorized third parties also known as "Payment Gateway" platforms (e.g. PayPalTM, OpenPayTM, Mercado PagoTM), as well as through the means made available by banking institutions, and therefore hereby authorize Nuve to share their personal and banking data with such companies. Payment processing will be carried out based on the privacy policies of the third parties subcontracted by Nuve for such purposes; therefore, the Client releases Nuve from all responsibility regarding any matter related to this.
However, the Client may make payment by credit or debit card. It is the Client's obligation to notify Nuve, via email at contacto@nuvenu.mx, of any undue or fraudulent charge on the card used on the Website as soon as possible so that Nuve can take appropriate action. Although Nuve will take the actions it deems pertinent to prevent or correct an undue charge, Nuve assumes no responsibility for such processing, so the Client hereby releases Nuve from any responsibility related to this section.
The prices of the Products offered through the Website include the respective Value Added Tax (hereinafter, "VAT") and any other applicable taxes. However, these prices do not include shipping costs of the Products to the Client's address, which will be detailed separately in each order and must be accepted and paid, prior to shipment, directly and exclusively by the Client. These costs must be accepted by the Client at the time of placing the order.
For international orders, tariffs, import taxes, shipping costs, and any delivery-related charges will be calculated and/or displayed at checkout when the platform allows, and must be covered by the Client.
The Client may select different types of products available on the platform, including, but not limited to, jewelry pieces designed by Valeria Rivas. Each product has a different cost due to its characteristics and manufacturing; therefore, the Client understands and agrees that the destination of the products may only be that established by these Terms and Conditions.
Nuve undertakes to deliver the Products purchased by the Client, in perfect condition, to the address indicated by the Client in the order form, provided that it is located within the national territory. In order to optimize delivery, the Client must indicate an address where the order can be delivered, within normal business hours, i.e., between 9:00 (nine) AM and 6:00 (eighteen) PM, Monday to Friday, on business days.
Nuve will not be responsible for errors caused in delivery when the delivery address entered by the Client in the respective order form does not exist, does not conform to reality, or has omitted data. Nuve informs the Client that a single order may be divided into several deliveries. Nuve reserves the right to cancel or limit the delivery of an order based on the courier's coverage.
The estimated delivery time will be stipulated based on each order and product availability. These periods are average times and, therefore, are only an estimate and not a guarantee of fulfillment, since delivery is carried out through third-party courier companies subcontracted by Nuve for this purpose. Therefore, delivery times may vary due to logistical reasons, or acts of God or force majeure.
Each delivery will be considered made from the moment the transportation and logistics company hired by Nuve makes the Product available to the Customer at the address indicated by the latter at the time of purchase, which is materialized through the control system used by the contracted transport company.
Delays in delivery will not be considered in cases where the order has been made available to the Customer by the transport company within the agreed period and the order could not be delivered due to reasons attributable to the Customer in question.
The risk of the Products (including, among others, loss, damage or theft) will be transferred to the Customer from the moment they have been made available at the delivery location.
If the Customer is absent at the time of delivery, it is the carrier's responsibility to indicate how to proceed to arrange a new delivery.
If 10 (ten) calendar days have passed after the order was dispatched for delivery and delivery could not be completed, the Customer must contact Nuve. If the Customer does not do so within 20 (twenty) calendar days from the dispatch of the order, it will be returned to its place of dispatch and the Customer must bear the shipping and return costs of the merchandise to the warehouse.
The Customer, under their sole and exclusive responsibility, must check the good condition of the package in front of the carrier who, on behalf of Nuve, delivers the requested Products, indicating any anomaly they may detect in the packaging on the delivery receipt. If, after checking the product, the Customer detects any incident such as a blow, breakage, signs of having been opened or any damage caused to the Product by shipping, they are obliged to notify Nuve by email within 48 (forty-eight) hours following its delivery.
Nuve does not have return processes for any of its products. In the event that a return of products arises based on the warranty granted by Nuve in clause 14 of these T&Cs, the Customer must contact Nuve directly via email contacto@nuvenu.mx, where they will receive exact instructions on how to enforce said warranty.
All shipping costs for returns when enforcing the warranty will be borne by the Customer.
Nuve offers a warranty on products for a period of 5 (five) calendar days after the Customer receives the products. This warranty only applies when:
- The piece arrives broken at the Customer's home, who must take a photo at the time of receipt and contact Nuve directly to proceed with enforcing the warranty;
- The piece or Product is stained or deteriorated in some way upon receipt of the Product;
- In the event that the clasp securing the Product is in poor condition (broken or not adequately functional), the Customer must immediately notify Nuve to enforce the warranty.
ONCE 5 (FIVE) CALENDAR DAYS HAVE PASSED AFTER THE RECEIPT OF THE PRODUCTS, NUVE DOES NOT GRANT ANY WARRANTY ON THEM, THE CUSTOMER AND/OR USER EXPRESSLY ACCEPTS THE TERMS GRANTED IN THIS WARRANTY.
Nuve ships to the United States through third-party international logistics providers. The Customer must provide a complete, accurate and verifiable shipping address at checkout. Nuve shall not be responsible for delays, failed deliveries, additional costs or losses caused by incorrect, incomplete or undeliverable addresses.
In-stock products may require between 2 and 6 business days to be prepared for shipment, depending on the product and its artisanal production process. Out-of-stock, personalized, pre-order and/or gold-plated products may remain in production for up to 20 business days.
Once shipped, the estimated international delivery time to the United States is between 6 and 10 business days depending on the delivery area, logistics coverage, customs processes and courier availability. Delivery times are estimates only and are not guaranteed.
International delivery times may vary due to circumstances beyond Nuve’s control, including but not limited to customs inspections, courier delays, weather conditions, holidays, high logistics demand, incorrect customer information or force majeure events.
Import duties, customs fees and taxes may be calculated and charged at checkout depending on the platform configuration available at the time of purchase.
Nuve shall not be responsible for delays caused by customs processes, inspections, package holds, additional information requests or any procedures carried out by customs authorities, shipping providers or third parties outside of Nuve’s direct control.
Once the order has shipped, the Customer will receive a tracking number to monitor the shipment. It is the Customer’s responsibility to track the package and respond to any communication from the shipping carrier related to the delivery.
If a package cannot be delivered due to reasons attributable to the Customer, including but not limited to incorrect address information, recipient absence, refusal of delivery or failure to comply with carrier requirements, the Customer shall be responsible for any additional shipping, storage, return or reshipment costs.
If a package is returned to Nuve for reasons beyond Nuve’s control, any new shipment must be paid for by the Customer.
Nuve does not accept international returns, exchanges or refunds for change of mind, incorrect product selection, sizing issues, shipping delays, customs fees, import taxes or any reason other than a verified manufacturing defect.
Personalized, made-to-order, pre-order, gold-plated or specially handcrafted products are not eligible for returns, exchanges or refunds unless they present a verified manufacturing defect upon delivery.
Nuve offers a limited warranty exclusively for manufacturing defects or visible damage present at the time of delivery. To request warranty support, the Customer must contact Nuve within 5 (five) calendar days after receiving the order and provide clear photographs of the product, packaging and shipping label to contacto@nuvenu.mx.
The warranty does not cover damage caused by normal wear, misuse, humidity, chemicals, perfumes, creams, sweat, accidental damage, improper handling, third-party alterations or any issue unrelated to a manufacturing defect.
In the event that Nuve determines the warranty claim is valid, Nuve will provide instructions for the applicable resolution process. International shipping costs related to warranty claims, replacements or returns may be the responsibility of the Customer unless otherwise stated by Nuve in writing.
ONCE 5 (FIVE) CALENDAR DAYS HAVE PASSED AFTER DELIVERY OF THE ORDER, NUVE SHALL HAVE NO OBLIGATION TO PROVIDE WARRANTY COVERAGE FOR PRODUCTS SHIPPED TO THE UNITED STATES.
Invoice requests: Should they require it, Customers must request their corresponding invoice via facturacion@nuvenu.mx by sending the following information: a) Full name or company name, b) Federal Taxpayer Registry (RFC), c) Complete tax address, d) Use of the invoice, e) Email address to which the corresponding invoice will be sent.
Invoices can only be requested within the calendar month in which the Products were requested and Payment was effectively processed. Nuve will send said invoice within the following 10 (ten) to 15 (fifteen) business days of receiving the request.
The quality of the services and products we provide to our Users is very important to us. Our User Support team (FAQ) will try to resolve any problems that may arise in the use of the Website. The User can contact our "Customer Service" by clicking or selecting the "(Contact)" option or similar button, or through the user support email contacto@nuvenu.mx
To use the Website, Nuve grants the User a free, temporary, non-exclusive and non-transferable license to request our Services in the national territory of the United Mexican States. To this end, the User agrees to refrain from altering, modifying, adapting, sublicensing, translating, alienating, reverse engineering, deciphering, decompiling or otherwise disassembling in whole or in part any portion of the Website and/or the computer files or programs that comprise it, or causing any third parties to do so on their behalf or not, with or without profit. The objects of this license may be modified at any time, and the license itself may be unilaterally revoked by Nuve, even without prior notice.
Although Nuve will endeavor to ensure that the Website is normally available twenty-four (24) hours a day, seven (7) days a week, Nuve will not be responsible if the Website is unavailable at any time or for any period of time.
Suspension of access: Access to the Website may be suspended temporarily or permanently without prior notice and at Nuve's sole discretion.
Information security: Unfortunately, the transmission of information over the internet is not completely secure. In order to comply with the Federal Consumer Protection Law and the Federal Law on Protection of Personal Data and its Regulations, we will adopt the necessary physical, administrative, and technical security measures to protect User information; however, we cannot fully guarantee the security of your data transmitted to the Website given the conditions of the device and/or connection you use to access the Website. Therefore, any transmission will be at your own risk.
Except for information related to your personal data, which is subject to Nuve's Privacy Notice, all content that the User inputs or links on the Website will be considered public, non-confidential, and therefore not private ("User Content"). By including such content, the User acknowledges and guarantees that they own or have all rights to it. The User acknowledges that Nuve will have no responsibility with respect to such content and may reproduce, disclose, distribute, incorporate, communicate it to the public, and use it in any other way, including data, images, sounds, text, and other elements included therein, for any commercial or non-commercial purposes that it determines at its discretion.
The User declares and guarantees that any Content they publish complies with the following restrictions:
It is strictly prohibited to publish or download on or from the Website any User Content (including Reviews) that: i) Violates any applicable local, national, or international law; is illegal or fraudulent; constitutes unauthorized advertising; or ii) Contains viruses or any other harmful programs ("malware").
In particular (but without limitation), comments and opinions that Users post through the Website or any Social Network page must not: i) Contain any defamatory, obscene, or offensive content; ii) Promote violence or discrimination; iii) Infringe the intellectual or industrial property rights of any other person; iv) Infringe any legal obligation to a third party (such as, for example, a confidentiality obligation); v) Promote illegal activities or invade the privacy of third parties; vi) Give the impression that they have been created by Nuve; vii) Be used by impersonating another person, natural or legal, or misrepresenting their affiliation with any other person.
The impermissible actions established in this section are not exhaustive. Nuve reserves the right to delete or modify at any time the opinions and other content published and disseminated by Users on the Website or Social Networks that Nuve considers to violate the prohibitions set forth in these Terms and Conditions, or that is objectionable or implies any damage or liability to Nuve, or to third parties.
Users agree to indemnify and hold Nuve harmless from any loss, damage and/or complaint and/or claim (and other related expenses) that may be incurred or initiated against Nuve, a Customer or any third party as a result of the Opinions or Content included on the Website in contravention of any of the declarations and guarantees, agreements or restrictions established in these Terms and Conditions.
Nuve will fully cooperate with any competent authority that, by duly founded and motivated order, requests or requires it to reveal the identity or location of whoever has published Opinions or User Content in breach of these Terms and Conditions or any other applicable restriction, legislation or regulatory provision.
Although Nuve tries to ensure that the information it provides through the Website is always correct, we cannot guarantee that it is always accurate or complete. Such information is provided solely as a reference and for product identification. The content of the Website may not be up-to-date, and Nuve does not commit to keeping it updated at all times, nor will it be responsible for it.
Nuve may terminate or suspend (at its sole discretion) both the right to use the Website and the use of its Services, even immediately, if: i) the Website is used in breach of these Terms and Conditions; ii) the User has published opinions or any other User Content in breach of these Terms and Conditions; iii) the User breaches any other stipulation of these Terms and Conditions; iv) upon termination or suspension, the User must immediately delete all extracts from this Website downloaded or printed.
Nuve is not responsible for any failure in execution or delay in the execution of any of our obligations under this Agreement that is due to events beyond our control ("Fortuitous Event and/or Force Majeure"), as well as declared pandemics, or the impossibility of acquiring raw materials for the Products.
Force Majeure shall be understood as any act, event, omission or accident beyond our control or that of our Clients, and includes in particular (without limitation) the following: Strikes, stoppages or any other industrial action; civil unrest, riots, invasions, terrorist attacks, wars (declared or not), threats or preparations for war; impossibility of transit on federal or local communication routes due to blockades, road closures or any other similar action by authorities or individuals; impossibility of using public or private telecommunications networks; and acts, decrees, legislation, regulation or restrictions of any government.
A Fortuitous Event is understood as any event not reasonably foreseeable by any of the parties or our Clients, and includes in particular (without limitation) the following: fire, explosion, storm, flood, earthquake, subsidence, epidemics and any other natural disaster; the consequences of such events, such as falling trees, advertisements, suspension of basic and/or telecommunications services.
Our obligations under this Agreement will be suspended for the duration of the Force Majeure event, and we will have an extension of the deadline for fulfilling our obligations for the duration of that period. We will endeavor by all means to end the force majeure event or find a solution by which we can carry out our obligations under these Website Terms and Conditions despite the Force Majeure Event.
The headings in these Terms and Conditions have been included for convenience and will not affect their interpretation.
In the event that any clause of these Terms and Conditions is declared ineffective by any competent authority, the rest of the provisions will remain unaffected and valid, interpreted as far as possible with the aim of preserving the will of the contracting parties and as if the provision or clause were null and void.
We reserve the right to modify these Terms and Conditions. The last update to these Terms and Conditions took place on May 22, 2026.
These Terms and Conditions shall be governed by and interpreted in accordance with the federal laws of the United Mexican States. Nuve and the Customers expressly waive any other jurisdiction or applicable legislation that may correspond to them now or in the future by reason of their domicile or for any other cause, and submit to the jurisdiction of the competent courts of Mexico City, Mexico.
